Federal Court Mandates Release of Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in federal custody.
In her order, the judge pointed out that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings involve disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
