The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his push for 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared operational insights of his 23XI team, revealing he put in $40 million of his own funds into the Cup Series operation co-founded with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan said during testimony. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport required examination through a new lens.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other major leagues with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with fans and media clamoring for a view or a picture of the sports legend.
Leading the Legal Charge
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from September 2024. Gibbs described a frantic and emotional period where the sanctioning body informed teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed spot in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to refuse a signature that extensive document and take the issue to court. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar refused to engage, according to his testimony.
The Ultimate Motivation: Winning
Ultimately, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.
“Hamlin persuaded me getting a third driver improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the pressure of the signature deadline was problematic.
She said, Joe Gibbs first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
